ELEVATEU LEGAL
Terms of Use
Effective September 6, 2026
1. Educational service
The Thinking Edge — Credit Union Edition is educational and professional-development content. It does not replace a Customer Organization’s policies, procedures, authority structure, compliance obligations, supervision, management judgment, or responsibility for decisions made in its workplace.
2. Organization purchases and administration
At launch, ElevateU is sold to organizations, not individual consumers. The purchasing organization is responsible for its authorized users, organization administration, and the accuracy of the information it provides. A person may hold more than one role. Manager and Organization Admin access alone does not consume a learner seat.
3. Payment and release of access
Stripe is the payment-event source of truth. Access is released only after CUelevate verifies a confirmed successful payment for the correct customer, order, currency, and amount. Processing or pending payment does not release access. There is no five-business-day post-payment hold. Duplicate or out-of-order payment events do not create duplicate seats. Returns, reversals, disputes, and similar adverse events may trigger the applicable suspension and review process.
4. Seats and access
Each purchase batch keeps its own purchase date and expiration; a later purchase does not extend an earlier batch. A learner seat that has never been activated remains available for up to five years from that batch’s purchase date. A seat activates when its assigned learner first successfully authenticates to the portal—not when the learner is invited, assigned, or has a record created. Activated learner access lasts 12 calendar months. Completion does not extend that period.
Activated seats remain consumed and are not ordinarily transferable or recyclable. Assigned but not-yet-activated seats may be corrected or reassigned through the approved organization-administration workflow.
5. Intellectual property and permitted use
CUelevate and its licensors retain all rights in the Platform, course content, assessments, scenarios, feedback, and certificates. Customer Organizations and users may not copy, redistribute, bulk screen-record, scrape, resell, use to create competing training, or use the Platform or its materials to train AI or machine-learning systems without CUelevate’s written permission. Assessments and scenarios may not be copied or distributed.
6. Reporting and certificates
Employer reporting may include enrollment, progress, assessment and completion status, competencies where applicable, and certificate information. A certificate reflects completion only. It is not a professional license, governmental certification, regulatory determination, or an expansion of workplace authority.
7. No outcome guarantee
CUelevate does not guarantee employee performance, regulatory outcomes, operational outcomes, or the elimination of errors or escalations.
8. Disclaimers and liability
To the maximum extent permitted by law, the Platform is provided on an “as available” basis. CUelevate disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. To the maximum extent permitted by law, CUelevate will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. CUelevate’s aggregate liability arising from the Platform will not exceed the fees paid by the Customer Organization for the applicable Product during the 12 months before the event giving rise to the claim.
9. Policies and support
The Refund & Cancellation Policy and Privacy Notice are incorporated by reference. For Platform assistance, an authorized manager or Organization Admin may contact training@cuelevate.com. Learners with a sign-in or verification-email delivery problem should first contact their organization’s IT department. For course content, assignments, and training expectations, learners should contact their manager.
10. Governing law
These Terms are governed by the laws of South Carolina, without regard to conflict-of-law rules, except where applicable law requires otherwise.
